Unless otherwise agreed in writing, these General Terms and Conditions (GTC) apply to 3Dripples kft., which operates the website https://jessence.hu/. If you disagree with any provision or have any remarks, please notify us immediately via the contact details above; otherwise, it shall be considered that you accept and agree with the terms described herein. 

The GTC sets out the terms and conditions related to our services, the rights and obligations of 3Dripples kft. as the Service Provider and the User, and other essential circumstances related to the use of the services. 

 

2. Order Process and Contract Conclusion 

You can place your order exclusively via the www.jessence.hu website or by email, 24 hours a day, seven days a week. If you need assistance, please contact our customer service at +36 20 2584835, Monday to Friday, between 8:00 and 16:30, or write to info@jessence.hu. 

 

We undertake to create your custom jewelry based on the parameters provided within the agreed deadline. The contract can be concluded in Hungarian, as well as in English. You will always receive a confirmation email regarding this contract, which includes your order number, delivery address, price, payment method, and delivery method. 

 

The invoice will be sent to you electronically and will include the gross consumer price of the jewelry and any applicable shipping costs. After this, you will pay via bank transfer, and only then will we begin processing your order. Please take this circumstance particularly into account. 

You will always receive a warranty certificate for the ordered jewelry. 

 

3. Prices 

After receiving your jewelry design, we will send you a price quote. The price depends on the complexity and weight of the jewelry to be created. 

 

4. Stock Availability 

Our company creates each piece of jewelry individually, taking into account the customer’s unique requirements to the fullest extent. Therefore, we do not maintain any stock. 

 

5. Shipping 

Products purchased on the Website are delivered anywhere in Hungary via the Posta courier service. For shipping fees, please contact info@jessence.hu. The package is sent as an insured shipment. Upon dispatch, you will be notified by email, allowing you to track your package via the Posta courier service or its website. 

If the courier is unable to reach the delivery address on the first attempt, the package will be re-delivered the following day, or you may arrange an alternative delivery time directly with the courier. Address changes cannot be made after dispatch, thank you for your understanding. 

 

In Hungary, personal pickup is also possible at the 3Dripples office, which can be selected during the ordering process. 

 

If, for any unforeseen reason, the delivery is delayed, we will notify you by email or contact you by phone. The Hungarian Precious Metals Testing Institute may conduct random detailed inspections of the jewelry, which we cannot predict in advance. While we strive to ensure quick service, some unexpected events may occur, as most of these pieces are custom-made. The sourcing of gemstones and fulfilling individual requirements may also take additional time, but we will coordinate this with you. 

 

The package will contain your ordered jewelry in a gift box, along with a warranty certificate and related information—please keep the warranty certificate carefully. The invoice will be sent to you electronically and will include the gross consumer price of the jewelry and any applicable shipping costs. Products will be shipped to the address provided during the order. Please provide an address where you are available during the day, as deliveries occur during business hours. Expected delivery time is indicated in working days. 

 

3Dripples makes every effort to meet delivery deadlines. However, we cannot be held responsible for delays or consequences caused by third parties outside the delivery agreement, by the User, or due to unforeseeable and unavoidable circumstances. If the package does not arrive within the specified timeframe, an investigation will be initiated with the courier, which may take several days. During this period, refunds or returns are possible only in specific, exceptional cases. 

 

6. Withdrawal (Right of Withdrawal) 

 

Since each product is custom-made according to the design you provide, you do not have a right of withdrawal in the case of proper contractual performance. 

 

However, in the event of breach of contract, the entitled party (in this case, you as the Buyer) is granted a right of withdrawal against the obliged party (in this case, 3Dripples kft.) as follows: 

 

Civil Code (Ptk.) 6:140. § [Withdrawal, Termination] 

 

  1. If, as a result of the breach of contract, the entitled party’s interest in the performance of the contract ceases, they may withdraw from the contract, or, if the pre-contractual situation cannot be restored in kind, they may terminate it, unless otherwise provided by law. 

 

  1. For the declaration of the entitled party to be valid, they must specify the reason for withdrawal or termination if the right exists for multiple reasons. The entitled party may switch from the specified reason to another reason. 

 

 

  1. The obliged party cannot claim monetary compensation for the service rendered without consideration if the entitled party proves that they cannot return the service for a reason attributable to the obliged party. If the entitled party has paid for the service, they may request a refund even if they cannot return the service, provided they prove that the reason is attributable to the obliged party. 

 

 

7. Secure Payment 

Payment can be made by bank card or bank transfer. 

3Dripples kft. has chosen PayPal to ensure secure online payments. The PayPal system safely handles personal data and provides protection against phishing. Its buyer protection system guarantees a refund in case of potential errors or complaints. Please note: if we suspect fraud or misuse, we may halt the transaction for security reasons. 

 

The production of the order begins only after the transferred amount has been received. The processing time depends on the transfer time between the two banks. 

 

8. Product Warranty 

 

3Dripples kft. provides a warranty for all its products! Join our satisfied customers by choosing quality and the extra benefits offered by our in-house workshop. 

 

Below, we present the basic concepts related to defective performance, warranty, statutory liability, and product liability, so that you can assert your legitimate claims properly. Please read carefully! 

 

Defective Performance: 

 

According to the main rule on defective performance in Section 6:157 of the Hungarian Civil Code (Ptk.), the obliged party performs defectively if, at the time of performance, the service does not meet the quality requirements specified in the contract or by law. 

 

The obliged party (in this case, 3Dripples kft.) does not perform defectively if the entitled party knew or should have known about the defect at the time of concluding the contract. 

 

In contracts between a consumer and a business, any provision that deviates to the consumer’s disadvantage from the statutory rules on warranty and statutory liability is void. 

 

The Civil Code also establishes the so-called presumption of defective performance, which means that in a contract between a consumer and a business, if a defect is discovered within six months of delivery, it is presumed to have existed at the time of performance, unless this presumption is incompatible with the nature of the item or the type of defect. 

 

In practice, this means that if a defect is discovered within six months, the burden of proof lies with the business (3Dripples kft.). By default, it is assumed that the defect already existed when you purchased from us, and we must prove otherwise. 

 

Statutory Warranty (Kellékszavatosság): 

 

This means that, for any product sold (including jewelry), the obliged party (the seller of the product or the service provider) is liable for defects under statutory warranty. Specifically, liability arises for defects that already existed in the product at the time of purchase, even if they were not yet detectable—these are often referred to as hidden or manufacturing defects. 

 

In sales contracts, the seller’s statutory warranty only applies to defects that were present in the product at the moment of purchase, even if not apparent at that time. 

 

The seller’s liability under statutory warranty is objective, meaning it is independent of whether the seller knew that the product had defects. Even a good-faith seller is responsible for defective performance toward the buyer. (Bad faith may be relevant only in terms of the buyer’s potential claim for damages.) 

 

Product Liability (Termékszavatosság): 

 

This means that if a movable product sold by a business to a consumer is defective, the consumer may require the manufacturer to either repair the defect or, if repair is not possible within a reasonable timeframe without harming the consumer’s interests, to replace the product. 

A product is considered defective if it does not meet the quality requirements in effect at the time it was placed on the market by the manufacturer, or if it does not have the characteristics specified in the manufacturer’s description. Therefore, your jewelry is not considered defective if it was produced according to your order and individual specifications, and if it possesses the characteristics stated in the description. 

 

3Dripples kft. is exempt from product liability only if it can prove that: 

 

  1. The product was not manufactured or marketed within the scope of its business or independent occupation; 
  1. The defect could not have been detected at the time the product was placed on the market, according to the current state of science and technology; or 
  1. The defect was caused by the application of a law or mandatory regulatory requirement. 

 

In the case of replacement, the statutory warranty applies to the replaced product, and in the case of repair, it applies to the repaired part of the product, for which the manufacturer remains responsible. 

 

 

Notification and Claim Deadlines 

 

According to the Civil Code (Ptk.), the consumer must notify the manufacturer of the defect without undue delay after discovering it. A defect reported within 12 months from its discovery is considered to have been notified without delay. The consumer is responsible for any damage resulting from delayed notification. 

 

The manufacturer’s product liability lasts for two years from the date the product was placed on the market. Once this period expires, the right to enforce the claim is forfeited. 

 

Product Liability in Case of Ownership Transfer: 
If the ownership of the product is transferred, the new owner may enforce the product liability rights against the manufacturer. 

 

Warranty: 

The warranty – commonly and popularly known as a “guarantee” – means that the party providing the warranty (3Dripples) is responsible for flawless performance in such a way that, in the event of a quality complaint arising during the warranty period, they are exempt from liability only if they can prove that the cause of the defect occurred after the performance, typically due to improper use or handling of the jewelry by the consumer. 

The warranty claim can be enforced within the warranty period. In the case of mandatory warranty, this is one year; for contractual warranty, the period specified in the legal statement establishing the warranty applies. If the party obligated to provide the warranty fails to fulfill their obligation within an appropriate deadline upon the request of the entitled party, the warranty claim can still be enforced in court within three months from the expiry of the deadline set in the request, even if the warranty period has already expired. However, missing this latter deadline results in the loss of rights. 

For the enforcement of warranty claims, the rules applicable to exercising rights under statutory warranty must be applied appropriately (see order below). The entitled party may switch from the chosen statutory warranty right to another. 

The enforcement of the rights granted under the warranty is conditional upon the buyer following the instructions in the user manual provided by 3Dripples Kft., as only by doing so does the jewelry remain in intact condition. 

The costs arising from switching rights must be borne by the obligated party, except if the switch was caused by the obligated party or if the switch was otherwise justified. 

 

Order of Warranty Rights: 

 

Whether the consumer relies on statutory warranty (kellékszavatosság) or warranty (jótállás) in the case of defective performance, they are entitled to four types of warranty rights under Section 6:159 (2) of the Civil Code (Ptk.): 

 

Repair/Replacement/Price reduction/Refund / Withdrawal from the contract  

 

This is especially important for products under statutory warranty or mandatory warranty, as the consumer enjoys the same four rights in case of a quality complaint. 

 

Under the new Civil Code, for contracts involving mutual obligations, the obliged party is responsible for defective performance under statutory warranty for two years from placing the product on the market, even if no warranty exists or the warranty has expired. 

 

Based on statutory warranty, the consumer may choose: 

 

  1. Repair or replacement, except if fulfilling the chosen warranty right is impossible, or if it would cause disproportionate additional costs for 3Dripples compared to fulfilling another warranty right, taking into account the value of the product in perfect condition, the severity of the breach, and the impact on the consumer’s interests. 

 

  1. Request a proportional price reduction, perform the repair at the cost of 3Dripples or have it performed by someone else, or withdraw from the contract if 3Dripples has not undertaken repair or replacement, cannot fulfill these obligations under the law, or if the consumer’s interest in repair or replacement has ceased. 

 

The Civil Code also provides that withdrawal is not allowed for insignificant defects. Repair or replacement must be performed within a reasonable period, considering the nature of the item and the intended use expected by the consumer, while minimizing inconvenience to the consumer. 

 

 

Who Bears the Costs? 

According to Section 6:166 of the Civil Code (Ptk.), the costs related to fulfilling warranty obligations are borne by the obligated party—i.e., 3Dripples  kft. 

Exception: If the defect was partly caused by the consumer’s failure to meet maintenance obligations, or if the consumer clearly did not follow the instructions regarding the proper use of the jewelry, the costs incurred for fulfilling the warranty obligation must be borne by the consumer in proportion to their contribution, provided that the consumer had the necessary knowledge about maintenance/use, or 3Dripples fulfilled its duty to provide proper instructions. 

Within what period can you make a warranty claim with us? 

According to the main rule of the Civil Code (Ptk.), the right to statutory warranty expires one year from the date of performance. However, in a contract between a consumer and a business, the warranty period is longer: 

The consumer’s statutory warranty claim expires two years from the date of performance. An important rule is that the period during which the item cannot be used properly due to repair does not count toward the limitation period. 

For the part of the jewelry affected by replacement or repair, the limitation period for the statutory warranty claim restarts. This rule also applies in cases where a new defect arises as a consequence of the repair. 

Cases in Which 3Dripples kft., as Seller, Is Not Liable for Warranty (Statutory Warranty / Kellékszavatosság): 

According to Section 6:157 (1) of the Civil Code (Ptk.), exemption from warranty liability occurs in the following two cases: 

  1. If the consumer (entitled party) knew about the defect at the time of concluding the contract. 
  1. If the consumer should have known about the defect at the time of concluding the contract. 

However, under the applicable legal regulations, even discounted (sale) products are subject to quality complaints for parts of the product that were not defective or had a defect unknown to the consumer. 

3Dripples kft. submits to the rule that if a buyer later returns the jewelry due to a defect outside the scope of prior information, the complaint must be handled, and the claim cannot be lawfully rejected on the grounds that “discounted items are not subject to warranty.” 

 

„Who has to prove what, and when, in the case of warranty and liability for defects?” 

 

 

There is a significant difference between the two legal concepts regarding the burden of proof. In the case of a warranty, the party liable under the warranty, 3Dripples, is only exempt from liability if it proves that the cause of the defect arose after the performance (for example, due to improper use by the buyer). In contrast, under the rules of liability for defects, as a general rule, the buyer, i.e., you, is obliged to prove their claim—that is, that the cause of the defect already existed in the product at the time of purchase and that the defect was not caused by the buyer’s improper use. 

However, in the case of liability for defects, it is important to note the rule applicable to consumer contracts, which constitutes an exception to the general rule: if a defect is discovered within six months from the performance, it must be presumed that the defect already existed at the time of performance. Accordingly, in the case of a defect identified within the first six months, the seller (3Dripples) is only exempt from liability if it proves that the product was free of defects at the time of sale—that is, the cause of the defect arose after the performance, due to improper use of the product. 

Thus, both during the full term of the warranty and the first six months of the period of liability for defects, the burden of proof lies with the liable party (3Dripples); they are only exempt from liability if they prove that the defect arose after the performance. 

It should be emphasized, however, that this presumption applies only to consumer contracts under the Civil Code. Therefore, this rule does not apply to a buyer who does not qualify as a consumer under the Civil Code. For a non-consumer buyer to successfully enforce their rights for a defect discovered within six months of performance, they must prove that the defect already existed at the time of performance. 

We also draw your attention to the exception to the exception: the above presumption does not apply, and the burden of proof still lies with the consumer in the first six months if the presumption is incompatible with the nature of the item or the type of defect. 

Product Liability: 
 

In the case of a defect in a movable item (product), you may, at your choice, exercise either your rights under warranty for defects in quality (kellékszavatosság) or your product liability claim (termékszavatosság). 

Under a product liability claim, you may only request repair or replacement of the defective product. A product is considered defective if it does not comply with the quality requirements in force at the time of marketing or if it lacks the characteristics stated in the description provided by the manufacturer. 

You may enforce your product liability claim within two years from the date the product was placed on the market by the manufacturer. After this period, you lose this right. Product liability claims can be enforced only against the manufacturer or distributor of the product. 

In the case of a product liability claim, you must prove the defect. The manufacturer (or distributor) is only exempt from product liability if they can prove that: 

  • the product was not manufactured or marketed in the course of their business activity, or 
  • the defect could not have been detected at the time of marketing based on the state of science and technology, or 
  • the defect results from the application of a legal regulation or mandatory official requirement. 

It is sufficient for the manufacturer (or distributor) to prove any one of these reasons to be exempt. 

Please note that you cannot enforce both warranty for defects and product liability claims simultaneously for the same defect. However, if your product liability claim is successfully enforced, you may still enforce warranty rights regarding the repaired or replaced part of the product against the manufacturer. 

 

 

Complaint Handling: 

 
In the case of a consumer dispute, please contact us at our head office or by email (see warranty information), and we will investigate your complaint.  

You may also initiate proceedings before the conciliation body operating alongside the county (or metropolitan) chambers of commerce and industry to enforce your consumer rights if we cannot resolve your complaint. According to the seat of 3Dripples kft., the competent body is the Baranya County Chamber of Commerce and Industry Conciliation Body.

For any problem with the product, we recommend attaching the ticket received at the time of delivery to the defective product. 

 

Exclusions from Warranty: 

 
The warranty does not cover defects arising from improper use of the product 

such as scratches, deformation, breakage, tearing, wear, effects of chemicals, or,  

in the case of jewelry with stones, stone loss due to impacts.  

Such defects cannot be repaired free of charge. Please read the warranty card information and other related documentation carefully. 

The warranty may not always apply in the following cases: 

  • If the jewelry was made according to your individual request or differs from the product image, in which case only quality complaints are accepted. 
  • After individual engraving (e.g., engraving a name), the product cannot be returned. 
  • Damage or stone loss caused by the buyer’s improper use of the product. 
  • The right of withdrawal does not apply to non-pre-manufactured products made according to the consumer’s instructions or explicit request, or to products clearly tailored to the consumer. 

 

The manufacturer may pass on to the buyer any damage resulting from improper use of the goods.If you do not feel confident ordering online, we recommend visiting one of our stores in person, where our skilled staff can discuss everything in detail. 

9. 3Dripples Services 

We also undertake the repair of jewelry after the warranty period. If another company performs repairs improperly, we are not obliged to fix any resulting damage. 

 

10. Comments and Consumer Reviews 

The 3Dripples marketing team monitors all consumer reviews. If a customer review or comment violates legal or ethical regulations (e.g., advertising, defamation, inappropriate remarks, etc.), 3Dripples reserves the right to delete or modify the comment in question. 

 

 

11. Protection of Personal Data 

 
Certain information and data are essential for taking orders, completing purchases, issuing invoices, and for warranty purposes. An inseparable annex of these Terms and Conditions (ÁSZF) is the Privacy Policy available on the website; please study it carefully and acknowledge that by registering, you accept its contents. The Privacy Policy is also separately accessible next to the registration button.

Regarding the statutory obligation to prevent money laundering, we inform you that in the absence of personal contact, the Authority requires that for cash-on-delivery purchases exceeding HUF 300,000, we must collect the following information from the purchaser:

  • Nationality 
  • Type and number of identification document 
  • For foreign individuals: place of residence in Hungary 

For organizations or companies: 

  • Name, abbreviated name 
  • Registered office, or in the case of a foreign company, the address of its Hungarian branch 
  • Company court registration number

All content on the 3Dripples kft. website (illustrations, texts, names, brands, images, videos) is the property of 3Dripples kft. and its business partners under contract. Any partial or full reproduction of the website’s content by any method or on any medium may only be done with the permission of 3Dripples kft. 

 

All information and textual content offered by our services are protected under Hungarian and international intellectual property and copyright laws. 3Dripples kft. does not permit copying, using, or distributing website content over which you do not hold ownership rights. Unauthorized use of the website’s content by a third party is illegal and subject to the sanctions provided by intellectual property law. 3Dripples kft. does not assume liability if an unauthorized user misuses rights granted to a third party. 

For matters not regulated in these GTC, as well as for the interpretation of these GTC, Hungarian law applies, with particular regard to: 

 

  • Act V of 2013 on the Civil Code (“Ptk.”), 
  • Act LXXVII of 2013 on adult education, 
  • Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society (“Elker. tv.”), and 
  • Government Decree No. 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses. 

 

The mandatory provisions of the applicable laws apply to the parties without any special stipulation.
